This Pavilion Rental Agreement (“Agreement”) is entered into by and between Gratz Borough, Dauphin County, Pennsylvania (“Borough”), and the undersigned renter (“User”).
1. Facility Use
The Borough agrees to permit the User to rent and use only the Gratz Borough Park Pavilion (“Pavilion”) for the date and time approved by the Borough. The User understands and agrees that this rental does not include exclusive use of Gratz Borough Park. All other park areas—including playgrounds, fields, courts, walking paths, restrooms, and open spaces—remain open to the public.
2. Fees & Payment
Rental fees, security deposits, and any applicable charges must be paid in full prior to use of the Pavilion. Failure to submit payment may result in cancellation of the reservation.
3. Assumption of Risk
The User acknowledges that use of the Pavilion and surrounding park areas is at the User’s own risk. The Borough makes no warranties regarding the condition, safety, or suitability of the Pavilion or park facilities.
4. Release & Indemnification
The User agrees to release, indemnify, defend, and hold harmless Gratz Borough, its Borough Council, officers, employees, agents, and volunteers from any and all claims, damages, losses, injuries, or liabilities arising from or related to the User’s event, activities, guests, or use of the Pavilion or park property.
5. Responsibility for Guests & Conduct
The User is responsible for the conduct, supervision, and safety of all guests, vendors, and participants associated with the event. All Borough ordinances, state laws, posted rules, and directions from Borough officials must be followed.
6. Damage to Property
The User shall be financially responsible for any damage to the Pavilion or park property occurring during the rental period. Costs for repairs or replacement may be billed directly to the User.
7. Prohibited Activities
The following are prohibited unless explicit written permission is granted by the Borough:
• Alcoholic beverages
• Fireworks or open flames
• Unauthorized vehicles on grass or restricted areas
• Commercial sales or vending
• Amplified sound
• Any activity posing a safety hazard or violating Borough ordinances
8. Weather & Natural Conditions
The Borough is not responsible for weather conditions or natural occurrences including insects, wildlife, or fallen branches. No refunds shall be issued for weather-related cancellations unless otherwise authorized by the Borough.
9. Cancellation & Termination
The Borough reserves the right to cancel or terminate this Agreement or an ongoing event if the User violates any term of this Agreement or if public safety concerns arise. No refunds shall be issued for events terminated due to violations.
